Powers of the head of state in forming the composition of the judiciary: comparative legal aspects of legal regulation

Abstract
The article analyzes domestic and foreign organizational and legal mechanisms for ensuring the implementation of the powers of the head of state in forming the composition of judicial bodies. The article considers the peculiarities of securing at the legislative level guarantees of independence of judges in the countries of the continental system of law of the republican mixed form of government. Various approaches to implementing the participation of the head of state in forming the composition of judicial bodies are revealed, which is due to the peculiarities of the current legal policy on ensuring the principles of separation of powers. It is concluded that in most countries the independence of judges is considered as a necessary guarantee protecting against influence on the justice process. It is noted that the powers to form the composition of judicial bodies cannot be realized within the framework of their own competence of political authorities. The issue of the need to develop issues of constitutional and legal policy to ensure the principles of separation of powers and independence of the judiciary in Russia, taking into account foreign experience is raised. It is proposed to include representatives of the public in the process of selection, appointment, termination of powers of judges in order to increase the trust of the judiciary on the part of the country’s population.
