Features of proof in investigation of crimes in a breviated form of inquiry

Author(s)
Mityukova Marina Aleksandrovna
Abstract
The article examines the problems of investigating crimes in a shortened form of inquiry. Noting the ambiguous attitude of scientists and practitioners to this simplified form of investigation, the author considers this type of inquiry as a summary proceeding, in which the emphasis on collecting evidence is transferred to the stage of initiating a criminal case. Having examined the prerequisites for abbreviated investigation – the commission of obvious crimes of minor or moderate severity, the author focuses on the methods of collecting evidence in abbreviated form of investigation, noting the gaps in legal regulation and problems of law enforcement practice of investigative bodies in each of them. The article analyzes the features of the subject of proof in the abbreviated form of inquiry and individual problems of improving the procedure for the abbreviated form of inquiry.
