The authors found that the transition period from a socialist state-administrative economic system to a liberal one, oriented toward private initiative and profit-making, revealed many problems related to legal issues of subsoil use. This circumstance has so far prevented the development of a single, comprehensive legal act regulating all aspects of subsoil use, despite the fact that disputes over the adoption of the Mining Code have been ongoing since the 1990s. The theoretical basis for understanding and identifying the characteristics of mining law and the Mining Code is being studied. It is emphasized that it is necessary to take into account the systemic legal characteristics of subsoil extraction, to respect the interests of participants in economic relations in this area, based on the basic legal principles of domestic subsoil use and the introduction of modern information and digital technologies for legal control. Ultimately, the article considers the issue of systematization in the field of subsoil use, which involves the creation of a unified Mining Code based on constitutional and other regulatory and legal principles of subsoil use in the Russian Federation
