The article is devoted to some problems of qualification and criminal prosecution of persons who have committed cruelty to animals. The reasons for the low rates of initiation of criminal cases for cruelty to animals are analyzed, based on up-to-date statistics on criminal prosecution for this category of crimes. The paper also analyzes the reasons for the lack of a unified practice of applying the qualifying features of this corpus delicti. The main conclusions of the research in the field of animal welfare are the need to develop and implement a mechanism that will ensure the actual application of the relevant articles of criminal legislation in practice, rather than their nominal existence
