The IAEA as a subject of forming norms of modern international atomic law: theoretical-legal and practical aspects

Abstract
The article examines the evolution of the legal status of the International Atomic Energy Agency as a key subject in the formation of norms of modern atomic law. The transformation of the IAEA's role from a developer of technical standards to an active creator of international legal norms in the context of new global challenges is analyzed. Special attention is paid to the precedent-setting role of the Agency in resolving crisis situations at nuclear facilities. The mechanism for implementing IAEA standards into national legal systems through the harmonization of legislation is studied. The special nature of the Agency's regulatory documents is substantiated, combining a recommendatory character with the de facto mandatory nature of their application. Specific features of the IAEA's norm-making process, based on expert authority and international consensus, are identified. The significance of the Agency's activities for creating a unified legal framework in the sphere of nuclear safety is determined. The formation of a hybrid regulation model, where soft law becomes an effective tool for unification, is substantiated. The IAEA's contribution to the development of international law through the creation of new legal customs and precedents is revealed
