Ideological foundations and legal content of the evolution of the constitutional doctrine of the PRC

Abstract
Examines the evolution of China’s constitutional doctrine, from Marxist tenets to the concept of “socialism with Chinese characteristics.” The influence of this doctrine on the country’s constitutional development is analyzed. It is noted that Chinese constitutionalism is grounded in political and ideological discourse. Two stages in the evolution of constitutional doctrine are distinguished: the Maoist stage, based on classical Marxism-Leninism, and socialism with Chinese characteristics, associated with the reform theories of Deng Xiaoping, Jiang Zemin, Hu Jintao, and Xi Jinping. It is established that as the constitutional doctrine of “socialism with Chinese characteristics” evolved, its content incorporated the most important principles of modern constitutionalism, such as the rule of law, the supremacy of the constitution, and respect for and observance of human rights
