The rules of article 798 of the Civil Code Russian Federation, dedicated to the contract of organizing the cargo carriage (COCC), and also connected with this article rules of civil and transport legislation are under consideration. COCC is characterized as obligational, organizing, mutual, consensual, free of charge contract. COCC has to oblige to accept and present cargos for transportation, this part of the COCC organizes contracts of carriage conclusion. As the COCC also contains other clauses of organizing cargos transportation (their list in the law is open), itʼs capable of organizing not only contract of carriage conclusion, but their fulfilment also. COCC is compared to other contracts (of carriage, constituent, simple partnership, preliminary) and also to other organizing transport contracts – the unnamed contract of giving transport and presenting cargo and the named agreement about organizing of straight mixed transportation service and the contract of organizing the work for cargo carriage securing. The most resemblance of COCC with frame contract is determined. Preliminary contract obliges to conclude the main contract directly, COCC obliges to provide necessary pre-conditions (to accept and present cargos for transportation) for main contracts of carriage conclusion. Such clauses of the COCC (in contradiction to other itʼs clauses) can not be considered as frame ones. If the contract organizes the cargo carriage, but it doesnʼt oblige to accept and present cargos for transportation, it isnʼt a COCC, but it can be considered as frame contract. The contemporary straight mixed transportation service regulation limits both possibility of COCC conclusion and possibilities of COCC themselves
