Examines the legal nature of the maintenance and maintenance fees for the common property of an apartment building. Legislative and judicial approaches to the qualification of this payment are analyzed, as well as existing conflicts in legal regulation are identified. The main attention is paid to the issue of distinguishing the concepts of “maintenance” and “repair” and defining their legal nature in the context of the civil law categories of “work” and “services”. Based on the analysis of judicial practice of arbitration courts, it is concluded that this payment has a mixed legal nature, combining the features of both an advance target contribution and payment for services rendered. Systemic law enforcement problems have been identified related to the inconsistency of the provisions of Part 18 of Article 155 of the Housing Code of the Russian Federation with the actual economic practice of management organizations, especially in bankruptcy proceedings. It is proposed to amend the current legislation aimed at clarifying the mechanism for handling targeted payments, their legal regime and the transfer procedure when changing the management company. Proposals have been formulated to improve the legal regulation of relations between owners of premises and management organizations.
