Undermining the authority of government bodies or the authority of a superior as a consequence of official crimes

Abstract
For many years, judicial and investigative practice has observed a common approach to the qualification of official crimes, where the fact of such a publically dangerous consequence as “undermining the authority of (internal affairs bodies, healthcare bodies, educational institutions, etc.)” is cited as an important argument for holding officials accountable for violations committed during their service. However, the attitude of courts, including the Supreme Court of the Russian Federation, towards this argument is not unambiguous. The purpose to identify the features of using the category “authority of power” and its undermining as a result of the official’s illegal actions in judicial and investigative practice. In the process of working on the research, both general scientific methods (analysis, synthesis, comparison, observation) and methods of legal science (legal-dogmatic, discourse-analyses) were used. The conducted research allows us to state that “authority” in matters of management is still important in the military-service sphere due to the specifics of these relations, but even there it refers to the authority of a specific superior (commander). In other areas of state and municipal administration, including economic matters, the authority of a government body or institution is not protected by law and does not belong to the protected interests of society or the state, and therefore damage to such authority cannot be recognized as a socially dangerous consequence of official crimes. However, in some cases, along with other circumstances, the discrediting of government bodies due to the illegal actions of officials may be recognized as part of the causal relationship in the event of publically dangerous consequences.
