The article raises the issues of determining the size of the crime in the qualification of violations of copyright and related rights. The controversial situations that arise in the practice of courts and investigative authorities when establishing this feature are analyzed. Based on the study of materials of criminal cases on specific cases, resolutions of the Plenum of the Supreme Court of the Russian Federation, and the results of scientific research on the stated issues, author's solutions to controversial issues are proposed. The conclusion is drawn about the need to improve both the text of the criminal law and the existing interpretation, fixed in the explanations of the highest judicial instance of our country
