Monitoring as an Element of the Mechanism of Experimental Legal Regulation

Abstract
The article considers monitoring as an independent element of the mechanism of legal regulation in the context of a legal experiment. It is shown that the expansion of the practice of experimental regulation is accompanied by an increase in permissible regulatory variability, which cannot be eliminated, but requires legal management. It has been established that monitoring ensures the preservation of the normative nature of experimental regulation and prevents the transformation of legal decisions into managerial practices devoid of legal guarantees. It is proved that monitoring is not identical to monitoring the implementation of norms and is not limited to the analysis of statistical indicators. Its purpose is to provide legal support for the experimental regime, which makes it possible to assess the preservation of the regulatory properties of legal means, compliance with the limits of impact on the legal status of subjects and the legality of deviations from general regulation. It is revealed that the lack of monitoring or its substitution with the final assessment leads to a loss of feedback in the mechanism of legal regulation and makes it impossible to legally assess the consequences of the experiment. Special attention is paid to the role of the annual state report as an institutional form of summarizing monitoring results. It is established that the report performs not only informational, but also analytical and human rights functions, providing public legitimization of experimental regulation and the possibility of its subsequent regulatory transformation. It is concluded that the legal value of the report is determined not by the fact of its preparation, but by the use of the conclusions contained in it when making decisions about the fate of experimental regimes. As a result, the position is substantiated that monitoring is a necessary condition for the legality of a legal experiment and performs the function of a legal filter that ensures the manageability of permissible legal uncertainty and the preservation of the link between experimental regulation and the system of legal values
